TERMS OF USE AND MEMBERSHIP AGREEMENT

Please read the terms below before using this website (www.proudathletics.co) (hereinafter referred to as the "SITE"). Any individual or legal entity that accesses or uses this SITE in any way is deemed to have accepted the following terms of use.

TERMS OF USE

The services offered on this SITE are provided by Proud Athletics Tekstil Sanayi Ticaret Limited Şirketi, located at Susuz Mahallesi 2. İnönü Caddesi, White Dream Sitesi, Küme Evler No:373/CE27, Yenimahalle/Ankara (Mersis No: 0733119189500001) (hereinafter referred to as “Proud Athletics”). Proud Athletics is the legal owner of the SITE and holds all rights to its use and control.

By accessing or using the SITE, all users and members are deemed to have accepted any amendments made by Proud Athletics to these terms of use.

DEFINITIONS

SITE: The online platform operated by Proud Athletics where various services and content are provided.

MEMBER: Any real person who completes the membership form with accurate personal information, whose membership is approved by Proud Athletics, and who uses the SITE to make purchases.

USER: Any person who visits the Proud Athletics website with or without making a purchase.

LINK: Any connection that enables access from the SITE to another website, file, or content, or vice versa.

CONTENT: Any information, file, image, program, number, price, visual, written, or audio element published or accessible on the SITE or other websites.

TERMS OF USE AGREEMENT: This electronic agreement established between Proud Athletics and real or legal persons who use the SITE’s services.

PERSONAL INFORMATION: Includes a member’s identity, address, email, phone number, IP address, visited sections of the SITE, browser type, domain, and visit date/time.

SCOPE OF SERVICES

The services provided through the SITE include but are not limited to: the sale and delivery of products listed on www.proudathletics.co, after payment has been completed by the MEMBER and provided the product is in stock. Proud Athletics ensures that products are delivered to the customer without defects via a shipping company within the committed timeframe.

Proud Athletics reserves the right to modify the scope or nature of the services offered on the SITE at any time. Changes are considered effective once published on the SITE.

Users must meet the conditions specified by Proud Athletics in order to benefit from certain services. These requirements may be changed by Proud Athletics at its discretion and will take effect once published on the SITE.

GENERAL TERMS

Users may only perform lawful and personal transactions through the SITE. All legal and criminal responsibility for actions carried out on the SITE lies solely with the USER or MEMBER.

Each USER and MEMBER agrees not to engage in any activity that may infringe upon the rights of Proud Athletics or third parties. Proud Athletics assumes no direct or indirect liability for any damages caused by USER or MEMBER actions.

The information, articles, images, trademarks, slogans, and all intellectual property found on this SITE are owned by Proud Athletics or licensed entities. Copying, altering, publishing, transmitting, or selling any part of the SITE content (including databases, source codes, designs, and media files) is strictly prohibited without written permission.

Users agree not to reproduce, distribute, modify, or exploit the SITE’s software, hardware, or content, nor engage in any direct or indirect competition with Proud Athletics.

Proud Athletics may use data provided by USERS and MEMBERS in accordance with the Privacy Policy and these Terms of Use.

Personal data will not be disclosed to third parties, except when legally required by authorized institutions or in limited cases where third parties act on behalf of Proud Athletics.

LIMITATION OF LIABILITY

This includes but is not limited to service interruptions, errors, omissions, or delays in transmission.

Users agree that Proud Athletics shall not be held responsible for any damages or expenses (including legal fees) arising from SITE use.

ASSIGNMENT OF AGREEMENT

Proud Athletics may assign this agreement, in whole or in part, to a third party at any time without notice.
However, USERS and MEMBERS may not transfer or assign this agreement to another party. Any such attempt will be deemed invalid.

FORCE MAJEURE

In all legally recognized cases of force majeure, Proud Athletics shall not be held liable for delayed or non-performance of its obligations under this agreement.
In such cases, Proud Athletics will not be deemed in default and will not be required to pay any compensation.

APPLICABLE LAW AND JURISDICTION

This “Terms of Use and Membership Agreement” is governed by Turkish Law.
Any disputes arising from it shall be settled by the courts and enforcement offices determined under Turkish legislation.
Proud Athletics reserves the right to initiate legal proceedings in the USER’s or MEMBER’s country if necessary.

EFFECTIVENESS AND ACCEPTANCE

This agreement enters into force on the date it is published on the SITE.
By using the SITE, USERS and MEMBERS are deemed to have accepted its terms.

Proud Athletics reserves the right to modify this agreement at any time.
Any updates, including version numbers and revision dates, will be announced on the SITE and become effective immediately upon publication.
